What Is The Timeframe For Disability Benefits?
When you apply for Social Security Disability Benefits you may not be aware, but there is a disability benefits time frame which governs when your payments will begin. Under the law, the Social Security Disability Program, workers or widows who have been approved generally will not begin to receive their benefits payments until five months after the established date of the onset. In other words, the Social Security Administration has determined when the onset of the disability was and then they added a five month waiting period onto that date after which the claimant will begin receiving disability payments. In addition, the claimant will not be able to receive Medicare benefits until two years after the effective date of entitlement of disability benefits. It is imperative that a person be able to present documented proof of the onset of their disability. The onset date is decided by and examiner who is appointed by the social Security Administration. The disability benefits time frame does not affect the individual who is filing as a child. It also does not affect workers who are applying for benefits. If the claimant is applying for SSI payments (Supplemental Security Income) the payments will probably start a month after the person was determined eligible to draw the benefits. Under the SSI program a person can be determined to be disabled and draw payments for as long as six months while waiting on a formal determination of benefits. Most Social Security disability cases take so long (two to three years) that the two year waiting period for receiving Medicare is either almost completely over or is over. If the need is an extreme necessity the disability claimant can be granted a quicker hearing by a judge. If they are granted an expedited hearing they can escape a long wait. There is no provision for a Title II disability applicant to be found presumptively disabled. If you are filing for disability benefits there is a disability benefits time frame that you may want to know about. Social Security is making changes to their processing programs. The have now implemented Quick Disability Determinations. The computer at SSA will seek and find particular kinds of disabilities that can be approved in twenty days. You can’t request the twenty day approval process. When you file your claim the computer will automatically screen your problems together with your medical evidence to decide if your claim will automatically be qualified for the twenty day approval process. When you do speak with Social Security on the phone they will not inform you of this program. When the Disability Determination Services receives your disability claim, the medical examiner does not have to set a time frame for processing your claim. However, it usually will take one hundred-twenty days before a determination is made on your case.
